Your Agreement with MinoLume

By using minolume.com (the "Site"), operated by MinoLume (hereinafter referred to as "we", "us", or "MinoLume"), you agree to these Terms of Service. If you do not agree, please do not use the Site.

Permitted Use of MinoLume

You may use the Site for lawful purposes only. Purchases are for personal, non-commercial use.

Prohibited Conduct on MinoLume

You agree NOT to misuse the Site, including but not limited to:
Uploading or transmitting viruses, malware, or other malicious code.
Using bots, crawlers, scrapers, or automated scripts to access the Site.
Attempting to gain unauthorized access to our servers, databases, or systems.
Interfering with or disrupting the integrity or performance of the Site.
Using the Site for any illegal or unauthorized purpose.
Harassing, abusing, or harming another person.
Collecting or tracking personal information of other users without their consent.

Account Termination by MinoLume

MinoLume reserves the right to terminate or suspend your access to the Site and our services at our sole discretion, without prior notice, for any conduct that we believe:
Violates these Terms.
Harms our business, reputation, or other users.
Is unlawful or fraudulent.

Upon termination, your right to use the Site will immediately cease. Any pending orders may be canceled and refunded at MinoLume's discretion.

Intellectual Property Rights of MinoLume

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by MinoLume, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without MinoLume's prior written consent, except as explicitly permitted by these Terms.

Orders & Payment on MinoLume

Placing an order constitutes an offer to purchase. MinoLume reserves the right to refuse or cancel orders due to product availability, pricing errors, suspected fraud, or violation of these Terms.

Order Cancellation

You may request to cancel your order within 2 hours of placement by emailing info@minolume.com with your order number. If your order has already been processed or shipped, MinoLume cannot cancel it; however, you can return the package for a full refund within 30 days using our return process.

Pricing Errors

If a product is listed at an incorrect price due to a system error, MinoLume reserves the right to cancel the order and issue a full refund.

Sales Tax

Purchases made on minolume.com are subject to sales tax based on the shipping destination. As a Washington-based business, sales tax is automatically calculated and collected for all orders shipped to addresses within Washington State. For buyers in other states, tax will be calculated at checkout only if required by local state regulations. All taxes are transparently displayed before purchase confirmation.

DMCA Takedown Policy

If you believe that any material on MinoLume's Site infringes your copyright, please submit a written DMCA notice to info@minolume.com. Your notice must include:
Physical or electronic signature of the copyright owner.
Identification of the copyrighted work claimed to be infringed.
Identification of the material claimed to be infringing.
Your contact information (address, phone, email).
A statement of good faith belief that use is not authorized.
A statement, under penalty of perjury, that the information is accurate.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall MinoLume, its directors, employees, partners, suppliers, or agents be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with:

Your use of or inability to use the Site.
Any conduct or content of any third party on the Site.
Any content obtained from the Site.
Unauthorized access, use, or alteration of your transmissions or content.

In no event shall MinoLume's total liability to you for all claims arising out of or relating to these Terms or your use of the Site exceed the total amount actually paid by you to MinoLume for the specific product giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you to the extent prohibited by law.

Dispute Resolution Process

Informal Resolution

Before filing a formal claim, you agree to contact MinoLume directly at info@minolume.com to seek an informal resolution. We will work with you in good faith to resolve any dispute within 30 days of receiving your initial notice.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved exclusively by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect at the time the claim is filed. The arbitration shall be conducted in Lacey, Washington, or via telephone or online if requested.

You and MinoLume agree that each party may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Class arbitration is not permitted.

Arbitration Fees

If you initiate arbitration, MinoLume will reimburse your filing fee up to a maximum of $500. If MinoLume initiates arbitration, we will pay all filing, administration, and arbitrator fees.

Opt-Out Right

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing info@minolume.com with "Arbitration Opt-Out" and your name and order number (if applicable).

Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.
